The examining magistrate is a judge of the district court who supervises the criminal investigation before a case goes to trial. The role is to check that police and the public prosecutor use coercive powers lawfully, for example by deciding on pre-trial detention (inbewaringstelling), wiretaps, and the hearing of witnesses. The examining magistrate does not decide guilt; that is for the trial court.
