Court declares au pair agency Nina Care bankrupt
The Noord-Holland court ruled against the au pair and nanny agency on Tuesday, after a judge's attempt to broker a settlement failed. Its founders say they want to start again.
The Noord-Holland district court declared au pair agency Nina Care bankrupt on Tuesday. A former employee who is still owed tens of thousands of euros applied for the bankruptcy. Trustee Rocco Mulder is handling the case.
The company was set up in 2020. The Immigration and Naturalisation Service (IND) revoked its permit to bring in au pairs from abroad, after 48 rule violations.
Co-founder Jasmijn Kok says she is working on a restart (doorstart). "Lyla and I don't give up easily," she said. She says the founders will give the company a fair new chance.
The trustee says he cannot yet say whether a restart is possible. "We have asked questions, but we don't have all the answers yet," Mulder said. First it must be clear what the assets and debts are, he said.
The former employee filed the bankruptcy application in August, Mulder said, and several court hearings followed. "The judge had proposed arranging a settlement, but that did not work out," he said. "That is why bankruptcy was declared on Tuesday."
Kok says a solution with the former employee was sought for a long time. "We won't be pressured into paying amounts that we also cannot responsibly bear," she said.

doorstart
A doorstart is the continuation of a bankrupt company's business by a new company, usually set up by the former management or founders. The new company takes over the business, assets, and often the staff from the bankruptcy trustee (curator), so that activities and jobs can continue without the old legal entity. It matters in the Netherlands because it is a common way to save a business or its employees after a bankruptcy declared by a court.
