AFM updates how it sets the size of its fines from 15 October
The Dutch financial markets watchdog has revised its fining policy, with more room for tailor-made decisions and a simpler calculation for heavier cases.
The Dutch Authority for the Financial Markets (AFM) has updated its policy for determining the amount of administrative fines (bestuurlijke boetes). The new Boetetoemetingsbeleid AFM 2026, its fine-setting policy, takes effect on 15 October 2026.
The AFM says it has adjusted the policy where needed and clarified some points. According to the authority, the changes are mostly technical and meant to clarify the rules.
Two changes stand out. The new policy offers more room for tailor-made decisions (maatwerk), so the AFM can adapt a fine to the case at hand. The calculation of fines for "heavier cases" (zwaardere zaken) has also been simplified.
